Automobile Accidents Caused From Cell Phone Usage

The National Safety Council (NSC) estimates that 28% of all traffic accidents are the result of drivers using cell phones and texting. NSC states that approximately 1.4 million crashes each year involve drivers using cell phones and a minimum of 200,000 additional crashes each year nationwide involve drivers were are texting. Indiana legislators have addressed the issue of phone usage in Indiana Code 9-21-8-59. This Statue, however, only applies to “moving” motor vehicles.  Therefore, in the State of Indiana it is legal to text, send or read an email or text from a telecommunications device so long as you are not operating a “moving motor vehicle.” If you or a loved one has been injured in a motor vehicle accident due to another driver’s cell phone use, please contact Schiller Law Offices.
